Terms of Service

Please read carefully. These Terms include a mandatory arbitration agreement and a class action waiver in Section 16. By using AURA, you agree to resolve disputes with us through individual binding arbitration rather than in court, and you waive your right to participate in a class or collective action.

Welcome to AURA. These Terms of Service ("Terms") govern your use of the AURA mobile application and the website at liveaura.app (collectively, the "Service"), operated by AuraForge, LLC ("we," "us," or "our"). By creating an account, tapping "I agree" during onboarding, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use AURA.

1. Eligibility

You must be at least 13 years old to use AURA. By creating an account, you confirm that you are 13 or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly allow users under 13 — if we discover an account belongs to someone under 13, it will be terminated.

AURA is intended for use within the United States. We do not target users outside the United States. If you access AURA from outside the United States, you do so on your own initiative and at your own risk, and you are responsible for compliance with local laws.

2. Your Account

AURA uses Google Sign In or Sign In with Apple for authentication. You are responsible for maintaining the security of your linked account. You may only create one AURA account. Creating multiple accounts to circumvent bans, score penalties, or other restrictions is a violation of these Terms and will result in permanent termination of all associated accounts.

Your name is set during onboarding and locked after that point. Your phone number is required for core features and must be a valid non-VoIP number.

3. The AURA Score and Vibes

The core action in AURA is called a vibe — not a vote. When you rate another user, you are casting a vibe.

Your AURA score is calculated from vibes cast by other users you have encountered in person. Scores reflect real-world interactions and are not editable by you. You have two independent scores (universal metrics and profession metrics) — these are never averaged together.

Scores are only visible once a user has received a minimum number of vibes. Below that threshold, no score is displayed.

You agree not to attempt to manipulate your own score or another user's score through coordinated activity, fake accounts, coercion, or any other artificial means.

4. Location and Proximity

AURA is a proximity-based app. Your location is shared with nearby users while you are active. This is a core, non-optional feature of the Service. By using AURA, you consent to your location being shared with nearby users for the purpose of enabling vibes and other proximity features.

You can stop sharing your location at any time by closing the app or revoking location permissions in your device settings, which will remove you from other users' nearby views.

AURA uses Bluetooth Low Energy (BLE) to enhance proximity detection. The app broadcasts a short anonymous identifier via BLE while running. You consent to this broadcasting as part of using the Service.

5. Community Rules

You agree not to use AURA to:

Harass, threaten, or harm any other user
Cast vibes with the intent to damage someone's reputation unfairly or maliciously
Stalk, surveil, or track another person without their knowledge using location features
Create fake accounts or impersonate others
Attempt to reverse-engineer, exploit, or tamper with the app or its backend
Use AURA for any unlawful purpose
Circumvent or attempt to circumvent geographic restrictions, invite requirements, or other access controls
Use AURA while operating a motor vehicle or in any manner that creates a risk of harm to yourself or others
Upload content (including profile photos) that you do not have the right to use, that infringes another person's copyright or other rights, or that violates any applicable law

6. User Content and Platform Status

AURA is an interactive computer service that hosts content created by its users. Vibes, scores, profile photos, names, and other user-submitted content are user content — not statements or expressions by AuraForge, LLC. We provide the technology platform; users provide the content and the judgments.

To the fullest extent permitted by law, AuraForge, LLC is not responsible or liable for user content, including vibes cast by users about other users. Vibes are expressions of subjective opinion by individual users about their personal experiences, and they reflect only the views of the user who cast them. AuraForge, LLC does not endorse, verify, or vouch for the accuracy of any user content.

We reserve the right (but have no obligation) to remove user content that violates these Terms or applicable law. We do not pre-screen user content.

You retain ownership of any content you provide (such as your profile photo). By submitting content to AURA, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit that content for the purpose of operating the Service.

7. Reports and Moderation

Users may report other users for misconduct. Reports are reviewed by AuraForge, LLC. We reserve the right to take any moderation action we deem appropriate, including warning, trust score deduction, shadowbanning, temporary suspension, or permanent termination of an account. Moderation decisions are final.

We do not guarantee any particular response time or outcome for reports. Filing false or malicious reports is itself a violation of these Terms.

8. DMCA / Copyright Infringement

AuraForge, LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that user content on AURA infringes your copyright, please send a written notice to our designated DMCA agent containing all of the following:

Your physical or electronic signature
Identification of the copyrighted work claimed to have been infringed
Identification of the material claimed to be infringing, with information sufficient to locate it on the Service
Your address, telephone number, and email address
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Repeat infringers will have their accounts terminated. If you believe content was removed in error, you may submit a counter-notice to the same email address.

9. Account Deletion and Score Penalties

You may delete your account at any time from within the app. Deleting your account carries a trust score penalty. If you re-join AURA after deleting your account, your score will start lower than a new user's starting score. This policy exists to protect the integrity of the reputation system and is non-negotiable.

Upon account deletion, your profile is deactivated and your public-facing information is removed. Some residual data may persist in our database backups for up to 7 days as described in our Privacy Policy.

10. Invite System and Geographic Restrictions

During early access, AURA is invite-only and geographically restricted to specific areas. These restrictions may change over time. Attempting to circumvent invite or geographic restrictions violates these Terms.

11. Subscriptions, Payments, and Auto-Renewal

AURA offers optional paid subscription tiers. The current tiers and pricing are:

AURA+ — $2.99 per month, billed monthly
AURA Pro — $4.99 per month, billed monthly

Subscriptions are processed through the Apple App Store or Google Play Store via RevenueCat. All purchases are subject to the payment terms of the applicable app store. We do not process payment card data directly.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Renewal charges are made to the payment method associated with your Apple or Google account.

How to cancel. You can cancel your subscription at any time through your device's app store subscription settings (Apple ID Settings → Subscriptions on iOS; Google Play → Payments & subscriptions on Android). Cancellation takes effect at the end of the current billing period.

Refunds. We do not offer prorated refunds for partial periods. Refund requests are handled by Apple or Google according to their respective policies. We may issue refunds at our discretion in cases of clear billing error.

Pro features (which may include features such as enhanced vibe weight or other premium functionality) are only available to active subscribers. If your subscription lapses, access to Pro features will cease at the end of the billing period.

12. Intellectual Property

All content, design, trademarks, and software comprising AURA are owned by AuraForge, LLC or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

13. Disclaimers

AURA is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any scores or ratings accurately reflect real-world qualities of any person.

AURA scores and vibes are expressions of subjective opinion by individual users. They are not factual statements, professional assessments, background checks, or endorsements by AuraForge, LLC. We are not responsible for how users interpret or act on AURA scores. AURA scores and vibes are not intended to be used, and may not be used, for any decision involving employment, housing, credit, insurance, or any other purpose covered by the Fair Credit Reporting Act (FCRA) or similar state laws. AURA is not a consumer reporting agency.

AURA is not intended to be used while operating a vehicle. AuraForge, LLC expressly disclaims any liability arising from use of the Service while driving or operating any vehicle or machinery.

14. Limitation of Liability

To the fullest extent permitted by law, AuraForge, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to damages related to reputation, loss of data, or loss of income. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of $100 or the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless AuraForge, LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of another user, or content you submit to the Service.

16. Binding Arbitration and Class Action Waiver

READ THIS SECTION CAREFULLY. It limits how you can pursue claims against AuraForge, LLC. By agreeing to these Terms, you and AuraForge, LLC are waiving the right to a jury trial and the right to participate in a class action.

Informal resolution first. Before filing any arbitration or legal claim, you agree to contact us at legal@liveaura.app with a written description of your dispute and to give us 60 days to attempt to resolve it informally. Most disputes can be resolved this way.

Agreement to arbitrate. If informal resolution fails, you and AuraForge, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision is final and binding. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Arbitration location and procedure. Arbitration will be conducted in Virginia Beach, Virginia, or by video/telephone, at the consumer's option for claims under $25,000. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Class action waiver. YOU AND AURAFORGE, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions. Notwithstanding the above, either party may: (a) bring an individual action in small claims court for any qualifying claim; (b) seek emergency or injunctive relief in court to protect intellectual property rights or to prevent unauthorized access to the Service; and (c) file complaints with applicable government agencies that can pursue claims on a party's behalf.

Opt-out right. You have the right to opt out of this arbitration agreement and class action waiver. To opt out, send written notice to legal@liveaura.app within 30 days of first agreeing to these Terms, including your name, the email address associated with your account, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other provisions of these Terms.

Severability. If the class action waiver is found unenforceable, the entirety of this Section 16 will be null and void, but the remainder of these Terms will remain in effect.

17. Governing Law and Venue (for non-arbitrable disputes)

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. For any disputes that are not subject to arbitration under Section 16 (for example, small claims actions or claims for injunctive relief), the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Virginia Beach, Virginia.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top. For material changes, we will notify you through the app and/or by email. Continued use of AURA after material changes go into effect constitutes your acceptance of the revised Terms. If you do not agree with material changes, your sole remedy is to stop using AURA and delete your account.

19. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any conduct we determine to be harmful to the Service or its users. Upon termination, your right to use AURA ceases immediately. Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, arbitration, and governing law) will survive.

20. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AuraForge, LLC regarding the Service. If any provision is found unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any provision does not constitute a waiver of that provision. You may not assign or transfer these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
